3. collection of your data

As part of your registration for EMG or Altmeyers Enzyklopädie and during your membership with EMG, personal data is collected or updated. The collection takes place in two ways:

  • by entering and submitting data in form fields or by sending us information by e-mail, mail or fax ("Active Data Collection")
  • By logging your actions when you use EMG services ("Passive Data Collection").

Regardless of the type of collection, EMG follows the principle of data minimization. We only collect data that is necessary or beneficial for our business mission and an optimal user experience.

3.1 Data that you provide to us

3.1.1 User master data

When you register, we collect the personal data required to provide our services to registered members in form fields when you set up your EMG account. This includes first name, last name, profession, field of expertise, field of activity, additional designations, postal code, street, city, e-mail address and a self-selected password. This data is assigned an individual user ID, which is assigned by EMG. Your password is stored using a one-way hash function. This means that it cannot be recovered or read by anyone, including EMG. This data processing is based on Art. 6 para. 1 sentence 1 letter b) DSGVO.

You can also use EMG in read-only mode without logging in, but then you will not have access to all content and features, you will not have a user profile, you will not be able to write or upload posts on EMG, and you will not receive personalized information.

3.1.2 Professional certificate

In order to verify the professional affiliation required by law for some content, we ask you to upload your professional credentials. If you provide EMG with proof of your affiliation to a medical profession, this proof will be stored in encrypted form with a link to your user profile. Without the mandatory data and the proof of profession, EMG cannot verify your affiliation to the medical profession and cannot grant access to information offers and services which, according to the provisions of the German Drug Advertising Act (HWG), may only be communicated to licensed medical professionals or which, for other, e.g. ethical reasons, are not made accessible to laypersons. You may use EMG services without a professional license, but you will then only have limited access. The above data processing is thus carried out to enable the extended use of your EMG account requested by you and is in this respect based on Art. 6 para. 1 sentence 1 letter b) DSGVO.

3.1.3 Photograph

If you wish, you can upload a photo in your profile at EMG. This photo will be displayed in your profile and will be visible to other registered users. Users have the option to publish their profile through an opt-in process. For content contributions by registered users, data such as name and profile picture of these users can be published in this context as source information. The data processing is based on your consent declared by the use of the upload option for the setting of a profile picture in accordance with Art. 6 para. 1 sentence 1 letter a) DSGVO.

3.1.4 Extended user data

As part of your use of EMG services, we ask you for additional information during registration and at irregular intervals after registration, e.g., what your professional interests are, whether and how you would like to be contacted by e-mail, or whether you would like to participate in market research studies. The extended user data that we collect is included in your user profile with the default setting "non-public". You can delete, add, publish or update this data at any time, depending on how much information you want to provide to EMG and other EMG users. The data processing is based on your consent declared by participating in market research studies or selecting interesting topics according to Art. 6 para. 1 sentence 1 letter a) DSGVO.

3.1.5 Ratings, contributions and files

When participating in EMG services, you can give ratings, write posts (e.g. comments, blogs, case questions), create author profiles and upload various files (e.g. images, lectures, scripts, videos). These reviews, posts and files will be linked to your user profile. By saving the contributions and/or uploading files, you agree to publish this data under your chosen author name or privacy setting. In addition, your publications will be displayed under in your user profile and in other places on the EMG website/services. The data processing here is based on your consent declared by using the respective functions in accordance with Art. 6 para. 1 sentence 1 letter a) DSGVO. In the context of the provision of our services requested by you, data processing is also carried out for the execution of the contract and is based in this respect on Art. 6 (1) sentence 1 letter b) DSGVO. Since EMG cannot check the content of files, you yourself must ensure that the contributions or files do not contain any personal data that violate your rights or the rights of third parties.

3.1.6 Communication data

We store whether and which emails you would like to receive from EMG (see also section 3.1.4.). If you communicate with EMG via email or chat or use the EMG Platform to communicate with other users or our editors ("Messages"), we store the communication content and any information you choose to provide. Without storing this communication data, EMG cannot perform customer service and you cannot use the EMG Platform to exchange messages directly with other users. The data processing is carried out for the provision and execution of the respective communication process or, in the case of your inquiry to the customer service, to answer this inquiry and is thus based on Art. 6 para. 1 sentence 1 letter b) DSGVO.

3.1.7 Market research data

If you participate in an optional market research study at EMG, we will store all the answers you provide when answering the questionnaire. Additional personal data (e.g. practice location or practice size) may also be collected in the process. Participation in market research studies is voluntary. We will ask you separately for your consent to the storage of your answers before your participation. In this respect, data processing is based on your consent in accordance with Art. 6 Para. 1 Sentence 1 Letter a) DSGVO. The data collected as part of market research will not be stored in your user profile. If you participate in a survey via chat or video telephony, we store the chat history and record the video. Irrespective of your consent to this privacy policy, we will ask you again separately for your consent to record this data before you participate. In this respect, too, the data processing is based on your consent pursuant to Art. 6 (1) sentence 1 letter a) DSGVO.

3.1.8 Authorization of the employer

If you would like to participate in a market research study as an employed physician, EMG requires your employer approval. You can send us the employer approval by e-mail or upload. It will be linked non-publicly with your user data record and stored for as long as required for the implementation of the study and the legal obligations to provide evidence. To this extent, the data processing is carried out in our legitimate interest of being able to prove that such permission was given and to fulfill a legal obligation to which we are subject. It is thus based on Art. 6 (1) sentence 1 letters c) and f) DSGVO.

3.1.9 Bank details and payment data

For participation in some EMG services, we request your bank details and payment information. We need this information for the payment processing of financial claims arising from participation in market research studies or the receipt of InMails. You do not have to provide us with your bank details, but you will then not be able to make any financial claims arising from market research studies, for example. Since the data processing thus serves the fulfillment of your payout claims, it is based on Art. 6 para. 1 sentence 1 letter b) DSGVO.

3.1.10 eCommerce

In the course of using the EMG Shop, we collect, among other things, your practice or company name, your billing address, your shipping address and your means of payment. This data is necessary for the fulfillment of the eCommerce transaction between EMG and you and will be stored for the legally determined duration. Without providing this data, no purchase contract can be concluded between you and EMG. The data processing is thus carried out for the execution of the contract and is based on Art. 6 para. 1 sentence 1 letter b) DSGVO.

3.1.11 Applicant data

You also have the option of using EMG for job applications and creating a public candidate profile on EMG. You determine the type and scope of the data provided in the candidate profile. You can refer potential employers to the profile you have published. The data processing here is based on your consent declared by using the application tool in accordance with Art. 6 para. 1 sentence 1 letter a) DSGVO.

3.2 Data that are collected automatically

3.2.1 Usage data

In terms of a user history, we collect information about your interactions with EMG, such as the pages or downloads you call up, your search queries in EMG Search, the channels, articles and users you subscribe to, logins to partner sites and apps that use EMG as an access system, participation in market research studies and other actions on the EMG platform. For the most part, this data is stored pseudonymously and cannot be viewed by third parties. Your usage data is primarily used to continuously improve the individual information offer that EMG makes to you. In addition, usage data is statistically evaluated in order to optimize EMG's services and user interface. Your usage data is also collected in order to increase data protection and data security in our company, so that an optimal level of protection for the personal data we process is ensured. In this respect, the processing of your data is carried out in our legitimate interest and is based on Art. 6 para. 1 sentence 1 letter f) DSGVO.

3.2.2 Log data

In the context of the use of EMG services, third-party providers whose offers are integrated into our websites via "embed" or iFrame (e.g. Sketchfab, Easyzoom, Trinket, Userlike, Youtube, etc.) collect your

  • IP address,
  • the access date and time,
  • the website from which the access is made (referrer URL),
  • Information about hardware and software used (e.g. browser characteristics) as well as
  • General device information (e.g. screen resolution)

This data is not used to draw conclusions about your person, but is used to ensure the correct display of the page or iFrame content. In this respect, the processing is carried out in our legitimate interest and is based on Art. 6 para. 1 sentence 1 letter f) DSGVO.

3.2.3 Shipping data

EMG stores information related to the sending of e-mails. This includes the type of e-mail, its date of sending, the information whether the e-mail was opened as well as any interactions that may have taken place in the e-mail (e.g. clicking on a button). This data is aggregated and processed in the form of anonymized statistics, which are used either by EMG or by third parties to analyze general user behavior in relation to e-mailing. Furthermore, we record when you have opted-in or opted-out of the various email types from EMG. We record the sending of the e-mails, the date of sending, the opening and the clicking of links in the e-mails for 24 months, after which they are deleted. In this respect, the processing is carried out to ensure the technical functionality of our services, the prevention of any use that may violate our terms of use and the proof of consent to receive e-mails. In this respect, it is carried out in our legitimate interest pursuant to Art. 6 para. 1 sentence 1 letter f) DSGVO.

When sending InMails (see GTC), EMG additionally stores the information whether and on which link you have clicked at the end of the InMail, so that we can allocate the amount accordingly to our donation account or your EMG customer account. In this respect, the processing is carried out for the calculation and settlement of your contractual payment claims and is thus based on Art. 6 para. 1 sentence 1 letter b) DSGVO.

3.2.4 Chat/message data

EMG stores the history of conversations between users and support staff that take place as part of user support via chat on the EMG website. Since the chat takes place without registration, i.e. anonymously, this conversation data cannot be assigned to an individual user, unless the user transmits data within the conversation on his or her own initiative that enables his or her identification (e.g. e-mail address). The processing of the chat data is carried out for the execution of the contract and is based on Art. 6 para. 1 sentence 1 letter b) DSGVO.

3.2.5 Payment transactions

In connection with payment transactions on the EMG platform, we store the payment instrument used, date and time of the transaction, payment amount, expiration date of the payment instrument and other transaction details. This information is necessary to adequately fulfill the contract between you and EMG and to enable the provision of the payment services and is in this respect based on Art. 6 para. 1 sentence 1 letter b) DSGVO.

3.2.6 EMG customer account

If you participate in InMail and market research studies, for example, EMG stores the payment claims you have acquired, as well as the actions that give rise to these claims, in your EMG customer account. This is done for contract processing and is based on Art. 6 para. 1 sentence 1 letter b) DSGVO. Since the acquired claims are subject to taxation, the storage period is based on the statutory retention obligations, a storage beyond the settlement thus serves the fulfillment of a legal obligation is based in this respect on Art. 6 para. 1 sentence 1 letter c) DSGVO.

3.2.7 Cookies

We use cookies and similar technologies such as tracking pixels. Depending on the purpose of processing, they are used to fulfill a contract pursuant to Art. 6 (1) sentence 1 letter b) DSGVO, in our legitimate interest pursuant to Art. 6 (1) sentence 1 letter f) DSGVO or based on your consent pursuant to Art. 6 (1) sentence 1 letter a) DSGVO. You can disable the use of cookies in your browser settings. Disabling them may result in reduced functionality or a loss of functionality. The EMG platform currently does not respond to a "Do Not Track" signal in the HTTP header of your browser or mobile application due to a lack of standardization regarding the interpretation of this signal.

4. storage of your data

Personal data is generally stored on EMG servers and is protected against modification and intervention by unauthorized third parties, among other things by access controls and firewalls. The processing of user data is mainly carried out internally. If third parties are involved in the data storage or processing, a contract for commissioned data processing exists with them, which guarantees the processing of your data at the same level with which EMG processes your data.

Professional credentials and employer approvals are stored partly electronically and partly as physical documents (depending on how a credential was issued).

When uploading files, some file formats (e.g. videos, PDF documents, PowerPoint presentations, etc.) are stored in cloud services. When uploading files, no personal data is transferred accompanying the file, the link of the files with the respective user is stored on servers of EMG.

Pseudonymized data collected in the context of the use of counting pixels is stored on the systems of the respective providers.

5. visibility of your data

In principle, you can determine the visibility of your data yourself. However, since EMG is a social media platform, a public display is preset for some of your data or activities in accordance with the following notes. EMG offers you a selection at the corresponding data fields, which defines different levels of visibility.

The visibility levels for the user master data and extended user data are "private" (= only visible to me), "contacts" (= only visible to EMG users you follow and who follow you), "EMG users" (= visible to all EMG users) and "all" (= public, i.e. also visible to users without EMG login).

The visibility levels for your assets are "draft" or "private" (= only visible to me), "medical professionals" (= only visible to EMG users with medical training), "EMG users" (= visible to all EMG users, i.e. also without medical training) and "all" (= public, i.e. also visible to users without EMG login).

Some of your personal data is also visible outside EMG by default. These are the first and last name, your profession, your area designation and your field of activity and your professional position. All other user master data and extended user data, are only visible if you have released them for a specific user group.

You can partially turn off the visibility of your data and its discoverability by search engines. However, the texts and files you publish may be partially publicly available and discoverable - for example, images, videos, or blog posts.

If you do not understand the visibility settings or have general concerns about publishing your professional profile or parts of it on the Internet, you should not use EMG.

6. use of your data

6.1 EMG services

We use the data listed in sections 3.1 and 3.2 when registering and using the various EMG services. The processing is thus carried out to provide these services and is based on Art. 6 para. 1 sentence 1 letter b) DSGVO:

Your user master data is the basis of your public profile at EMG and allows you to access the various content and features of EMG. This allows you to post comments, create content and upload files at EMG under your name and make them available to other users. Furthermore, you can post candidate profiles, job offers or job searches on EMG. We use your delivery address to deliver goods ordered by you. We use your bank data to pay out your claims which you have acquired against EMG, e.g. by participating in market research studies or receiving InMails.

6.2 Authorization

If you belong to the licensed medical professions, your data authorizes you to access content which, according to the provisions of the German Drug Advertising Act, may only be accessible to medical professionals (e.g. information on prescription drugs). In this respect, we also process the data for the purpose of fulfilling the contract (Art. 6 (1) sentence 1 letter b) DSGVO) as well as for fulfilling a legal obligation (Art. 6 (1) sentence 1 letter c) DSGVO).

6.3 Personalization

In order for you to preferably see content that corresponds to your professional activity and interests, we use your data to personalize the information on EMG. In this way, you will receive personalized pages that will give you an overview of news on channels to which you have subscribed. The same applies to the information you receive by e-mail with EMG News. The data processing in this respect is carried out for the fulfillment of the contract as well as in our legitimate interest to make our offers more user-attractive and is based in this respect on Art. 6 para. 1 sentence 1 letter b) and f) DSGVO.

6.4 Improvements

We use your data to continuously improve our services. By analyzing usage data, we can see if errors occur when using our services or if problems arise in understanding the user interface. In addition, we can see which areas and assets of EMG are particularly interesting for users and which content we may still need to optimize. The data processing in this respect is based on Art. 6 para. 1 sentence 1 letter f) DSGVO and is carried out in our legitimate interest of measuring the reach and improving our services for the benefit of a better user experience.

6.5 Communication

We need your data to ensure smooth communication between you and EMG via e-mail. The data enables us to address you personally and to adapt the e-mail dispatch to your wishes. In this respect, the data processing is carried out to answer your inquiry and thus to fulfill the contract as well as in our legitimate interest to ensure the technical functionality of our services and to personalize them for the benefit of a higher user-friendliness and attractiveness. In this respect, it is based on Art. 6 (1) sentence 1 letters b) and f) DSGVO.

6.6 Marketing

We use your data to make you aware of new services from EMG that are relevant to your interest profile and professional activity. The data also enables us to play out our advertising or third-party advertising in such a way that it reaches the right recipient without wastage. Your data is then also used to evaluate the success of marketing measures. We make this evaluation available to advertising customers. However, it contains only anonymized and aggregated data, so that no information about your individual response to advertising is passed on to third parties. This data processing serves to finance our internet offer, it is therefore in our legitimate interest and is based in this respect on Art. 6 para. 1 sentence 1 letter f) DSGVO.

6.7 Market research

We use your data to invite you to market research studies. We use data you provide as part of market research studies to conduct our own studies or studies on behalf of clients. Because market research helps fund EMG services, we have a legitimate business interest in collecting this data. Your participation enables us to provide you with our services free of charge. The data is pseudonymized and aggregated as part of the evaluation, so that neither the raw data nor the evaluation allow us to draw conclusions about a specific person. We use an employer authorization to check whether employed physicians are allowed to participate in our market research in accordance with the rules. 6.8 Statistics

We use pseudonymized and anonymized data for legitimate business interest (Art. 6 para. 1 sentence 1 letter f) DSGVO) to improve and finance our internet offer in order to develop usage statistics, overall analyses and business intelligence strategies. They enable us to make informed decisions, inform advertisers about EMG's reach, and report on our business performance.

6.9 Customer support

We store your communication with EMG in order to support you in solving problems in dealing with EMG. The related data processing is thus based on the fulfillment of the contract and is based on Art. 6 para. 1 sentence 1 letter b) DSGVO.

6.10 User security

We want to create a trustworthy environment for the exchange of professional information. Your public profile and professional credentials give other users the assurance that medical statements are backed by the necessary expertise. We use stored IP addresses to prevent misuse of your password after it has been spied on, lost, or shared. An indication of misuse of a password arises, for example, if it is used by several IP addresses. Since your EMG password gives access to your user profile, this mechanism serves your data security. The data processing in this regard is thus also carried out in our legitimate interest to increase data security and is based on Art. 6 para. 1 sentence 1 letter f) DSGVO.

6.11 Availability

We collect the data mentioned in section 3.2.2 to improve the availability of our services. Among other things, they serve to ensure a smooth connection of the website, system stability and the responsive display of content on various end devices. The data processing in this respect is carried out in our legitimate interest in this regard and is based on Art. 6 para. 1 sentence 1 letter f) DSGVO.

6.12 Conflict resolution

We use your data to resolve possible conflicts between you and EMG, for example, if it is unclear whether you have consented to receive e-mails or not. The data processing is therefore in our legitimate interest to be able to keep appropriate records and is based in this respect on Art. 6 para. 1 sentence 1 letter f) DSGVO.

7.1 Conditions of passing on

Your personal data will not be disclosed or transferred to third parties and companies unless,

  • You have expressly consented to this transfer (Art. 6 para. 1 sentence 1 letter a) DSGVO);
  • EMG is obliged to do so due to an official requirement or by virtue of statutory regulations (Art. 6 para. 1 sentence 1 letter c) DSGVO); it is necessary in order to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data (Art. 6 para. 1 sentence 1 letter f) DSGVO);
  • it is necessary for the processing of contractual relationships with you (Art. 6 para. 1 sentence 1 letter b) DSGVO);
  • there is a legitimate business interest of EMG, e.g. because we use order processors, especially if EMG has to rely on third-party web services.

7.2 Commissioned data processing

EMG uses commissioned data processors when sending emails and collecting market research results.

The sending of emails is done by MailChimp for EMG. For this purpose, MailChimp receives email address, title, salutation and other user parameters from EMG so that emails can be sent with a personal address. The conditions of data processing are fixed in an order data processing contract with MailChimp. MailChimp is prohibited from passing on user data to third parties. For so-called transactional emails (e.g. notifications, confirmations, requests, etc.) EMG uses the email service AWS. AWS is prohibited from passing on user data to third parties.

7.3 Usage statistics/market research results

Usage statistics and market research results that EMG makes available to third parties contain only anonymized and aggregated data. It is not possible to draw conclusions about an individual person. If it makes sense to pass on your personal data (e.g. in the case of side effect reports within the framework of drug safety), EMG will point this out to you. You can follow this advice and consent or object to the transfer.

8. duration of data storage

Your data will remain stored by EMG until you delete your EMG account or it is determined by a legal retention period. If your account is inactive for more than 24 months, i.e. you have never logged in to EMG during this time and have not responded to any emails from EMG, we will delete your account if there are no legal retention periods to the contrary. If you wish to use EMG again after this period, you must create a new user account.

9. data security

When using the EMG website, we use SSL so that the transmission of data between you and EMG is encrypted if your browser supports this technology. As a rule, this is a 256-bit encryption. If your browser does not support 256-bit encryption, we will fall back to the next available standard. You can recognize the encryption by a lock or key symbol on your browser.

EMG takes appropriate technical and organizational security measures to protect your data stored with us against data loss or unauthorized access by third parties with manipulation, theft or destruction. Our security measures are based on the current standard and are continuously improved in line with technological developments.

10. analysis tools

The data mentioned under 3.2 is partly collected with external third-party analysis tools, which are listed below. The legal basis for data processing is a legitimate interest in processing pursuant to Art. 6 (1) f DSGVO. This lies in the needs-based design and ongoing optimization of our website, as well as in maintaining the functionality of the application and in the coverage measurement necessary for media companies to exercise freedom of the press, Art. 5 (1) GG.

10.1 Google Analytics

For the purpose of demand-oriented design and ongoing optimization of our pages, we use Google Analytics, a web analytics service provided by Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter "Google"). In this context, pseudonymized usage profiles are created and cookies are used (see under section 4). The information generated by the cookie about your use of this website such as.

This information may also be transferred to third parties if this is required by law or if third parties process this data on our behalf. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymized so that an assignment is not possible (IP masking).

You have the right to receive from us at any time, free of charge, information about the personal data stored about you and a copy of this information. Furthermore, you have the right to information about the following information:

  • the processing purposes
  • the categories of personal data that are processed
  • the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular in the case of recipients in third countries or international organizations
  • if possible, the planned duration for which the personal data will be stored or, if this is not possible, the criteria for determining this duration
  • the existence of a right to obtain the rectification or erasure of personal data concerning him or her, or the restriction of processing by the controller, or a right to object to such processing

11.2 Right to correct incorrect and complete incomplete data

You have the right to request the immediate correction of inaccurate personal data concerning you. Furthermore, you have the right to request the completion of incomplete personal data - also by means of a supplementary declaration - taking into account the purposes of the processing.

For this purpose, EMG offers you the possibility to edit a large part of your data yourself in your user account. However, some of your data (in particular your profession or name) cannot be changed directly by you. If you would like to exercise your right of correction, you can contact our data protection officer or another member of our staff at any time.

Your right to rectification of incorrect and completion of incomplete data is based on Art. 16 DSGVO.

11.3 Right to data deletion (right to be forgotten)

You have the right to request that we erase the personal data concerning you without delay, provided that one of the following reasons applies and to the extent that the processing is not necessary:

The personal data were collected or otherwise processed for purposes for which they are no longer necessary.

You withdraw your consent on which the processing was based pursuant to Art. 6(1)(a) DSGVO or Art. 9(2)(a) DSGVO and there is no other legal basis for the processing.

You object to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Article 21(2) of the GDPR.

The personal data have been processed unlawfully.

We are obliged to delete your personal data in order to comply with a legal obligation under Union or Member State law.

The personal data was collected in relation to information society services offered pursuant to Art. 8 (1) DSGVO.

If one of the above reasons applies and you wish to arrange for the deletion of personal data stored by us, you can contact our data protection officer or another member of our staff at any time. Our data protection officer or our employee will arrange for the deletion request to be complied with immediately.

Please note that depending on the extent of your deletion request, deletion of your data may also end the use of your EMG account, including the use of the EMG password to log in to third-party websites.

Documents that you have uploaded and published while using EMG under acceptance of the EMG GTCs, e.g. texts, images, videos are no longer linked to your user account after deletion on EMG. Since EMG cannot check whether documents published by you contain personal data, you must notify us separately if these documents are also to be deleted. We therefore ask you to give us this notice together with the request to delete your account, otherwise we will no longer be able to clearly identify your documents.

Your right to data deletion is based on Art. 17 DSGVO.

11.4 Right to restriction of processing

You have the right to request us to restrict processing if one of the following conditions is met:

  • You dispute the accuracy of the personal data for a period of time that allows us to verify the accuracy of the personal data.
  • The processing is unlawful and you object to the erasure of the personal data and request instead the restriction of the use of the personal data.
  • We no longer need the personal data for the purposes of processing, but you need it to assert, exercise or defend legal claims.
  • You have objected to the processing pursuant to Art. 21 (1) DSGVO and it is not yet clear whether the legitimate grounds of our company outweigh your rights.

If one of the above conditions is met and you wish to request the restriction of personal data stored by us, you may contact our data protection officer or another member of our staff at any time. Our data protection officer or another employee will arrange the restriction of the processing.

Your right to restrict processing is based on Art. 18 DSGVO.

11.5 Right to data portability

You have the right to receive the personal data concerning you, which has been provided to us by you, in a structured, common and machine-readable format. This includes and you have the right to transfer this data to another controller without hindrance from us, provided that (i) the processing is based on consent pursuant to Article 6(1)(a) of the GDPR or Article 9(2)(a) of the GDPR or on a contract pursuant to Article 6(1)(b) of the GDPR and (ii) the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in us.

Furthermore, when exercising your right to data portability, you have the right to have the personal data transferred directly from one controller to another controller, insofar as this is technically feasible and insofar as this does not adversely affect the rights and freedoms of other individuals (Article 20(1) of the GDPR).

Your right to data portability in this regard is based on Art. 20 DSGVO.

11.6 Right of objection

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Art. 6(1)(e) or (f) DSGVO. This also applies to profiling based on these provisions.

We will no longer process the personal data in the event of objection, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the purpose of asserting, exercising or defending legal claims.

If we process personal data for the purpose of direct marketing, you have the right to object at any time to the processing of personal data for such marketing. This also applies to profiling, insofar as it is associated with such direct advertising. If you object to us processing for direct marketing purposes, we will no longer process the personal data for these purposes.

In addition, you have the right to object, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out by us for scientific or historical research purposes or for statistical purposes pursuant to Article 89(1) DSGVO, unless such processing is necessary for the performance of a task carried out in the public interest.

To exercise your right to object, you may contact our data protection officer or another member of our staff directly. You are also free to exercise your right to object in connection with the use of information society services, notwithstanding Directive 2002/58/EC, by means of automated procedures using technical specifications.

Your right to object is based on Art. 21 DSGVO.

11.7 Automated decisions in individual cases including profiling

You have the right not to be subject to a decision based solely on automated processing - including profiling - which produces legal effects concerning you or similarly significantly affects you, unless the decision is necessary for the conclusion or performance of a contract between you and us, or is permitted by Union or Member State law to which we are subject, and that law contains adequate measures to safeguard your rights and freedoms and legitimate interests, or is based on your explicit consent.

If the decision is necessary for the conclusion or performance of a contract between you and us, or if it is made with your express consent, we will take reasonable steps to protect your rights and freedoms and your legitimate interests, which include at least the right to obtain the intervention of a person from our company, to express your point of view and to contest the decision.

If you would like to assert your rights with regard to automated decisions, you can contact our data protection officer or another member of our staff at any time.

These rights are based on Art. 22 GDPR.

11.8 Right to revoke consent under data protection law

You have the right to revoke consent to the processing of personal data in whole or in part at any time.

The revocation of consent shall not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

Your right to revoke a consent granted under data protection law is based on Art. 7 (3) DSGVO.

11.9 Right of complaint to the supervisory authority

You have the right to lodge a complaint with the supervisory authority. This right is based on Art. 56 (2) DSGVO.
