Goä no.3

Both the No.1 and No.3 GOÄ are expressly also available by telephone. Just like the telephone, e-mails also enable the possibility of speech and counter-statement, which is typical for consulting. A problem could be seen in the professional code of conduct (prohibition of remote treatment). The Medical Association writes in "Notes and explanations on §7 para. 4 MBOÄ (remote treatment)": "According to this, medical advice and treatment of a patient using print and communication media is not fundamentally inadmissible; only the exclusive remote treatment is according to §7 para. 4 MBOÄ (remote treatment). MBO-Ä prohibited by professional law".

It is important that the patient himself or herself or an authorised person is the recipient if e-mails are used. Answering machines or faxes are excluded here, as they do not allow the speech and counter-statement typical for consultation.

Indirect consultations:

Consultations do not necessarily have to be made with the patient himself. An indirect consultation (Medical Association of Baden-Württemberg) is given if the conversation is with an authorized reference person.

Consultations cannot be delegated:

No matter in which form, consultations are only calculable if the doctor is personally active. In the case of the activity of an assistant, the No. 2 GOÄ (transmission of findings or medical orders) can be applied from the time of the assistant.
